The Johannesburg High Court will rule on 26 November on an application by accused in the Transnet corruption case to have the matter struck off the roll because of alleged unreasonable delays.

Judgment was reserved on Wednesday, 21 October, Eyewitness News reported. The application concerns section 342A of the Criminal Procedure Act.

Former Transnet executives Brian Molefe, Anoj Singh and Siyabonga Gama are among those facing charges.

The prosecution relates to alleged wrongdoing surrounding the procurement of 1,064 locomotives valued at more than R54bn.

Access to electronic evidence remains a central dispute. According to a separate EWN report, the State has proposed making extensive datasets searchable to help the defence prepare.

Business Day reported that prosecutors disputed responsibility for the delays, arguing that the defence had requested substantially more postponements than the State.

The forthcoming ruling concerns the handling of the proceedings and alleged delays; it will not determine the accused’s guilt or innocence.
