ConCourt ruling against Wild Coast exploration could trigger economic fallout, government warns

Government has expressed concern over the potential economic fallout from the Constitutional Court's decision to block Shell and Impact Africa's offshore exploration activities along the Wild Coast.

Mikateko Mahlaule, chairperson of Parliament's Portfolio Committee on Mineral and Petroleum Resources, said that while the committee respects the court's authority, prolonged legal uncertainty could carry serious consequences for investment and job creation in the country's petroleum sector.

He warned that South Africa cannot afford for significant economic and employment opportunities to remain stuck at the conceptual stage due to uncertainty around exploration.

The ruling, which followed concerns over inadequate community consultation and environmental considerations, effectively halts exploration activity in the region.

Mahlaule acknowledged the importance of meaningful community consultation and proper environmental consideration in decisions over natural resources, but argued that economic development and environmental protection need not be mutually exclusive.

He called for a regulatory framework that protects the environment and affected communities' rights while giving investors sufficient certainty to pursue responsible exploration.

Mahlaule defended the broader case for exploration, saying it is essential to establishing whether resources exist and can be developed for economic benefit.

He cautioned that continued uncertainty risks costing the country investment, skills development and employment opportunities, and that South Africa cannot afford to fall behind other resource-rich nations in attracting exploration investment.

The Portfolio Committee will continue engaging with the Department of Mineral and Petroleum Resources on the judgment's implications, with discussions focused on regulatory certainty and creating an investment-friendly environment while upholding environmental protections and community rights.

The ruling is the latest development in a long-running dispute over offshore exploration along the ecologically sensitive Wild Coast, which has drawn sustained opposition from environmental groups and coastal communities.
